correspondent john miller, former fbi national intelligence official, joins us with the latest on the fbi and the president of justice investigations. good morning. >> good morning, charlie. we spoke a friend of the broadwell family who told us they were overwhelmed by the outpouring of support from neighbors. 25 of them came over with all kinds of food and kind of set up camp there. on the home front it looks like things are coming back together. on the legal front there's a little more concern. let's go through the mechanics here. when this starts out, the agents get the stalking complaint and instead of waiting to get through the case and then bring it to a prosecutor, right at the beginning, because they see who this might involve, they go to an assistant u.s. attorney and say, if we go through with this, is there a prosecution your office would go forward with? and that tampa office says yes. then the special agent in charge of the tampa office reviews the case. he says this involves some big names. some interesting possibilities. let's kick this up a level. he brings it to robert o'

. >> requests by fox news to find out when paula broadwell knew she was the subject of an fbi investigation and whether it was before the attack in benghazi there maybe no comment from the fbi, shep. >> shepard: all right, catherine. you are learning more about what general petraeus said in that closed door meeting? >> well, shep, fox news has told the former cia director david petraeus insisted at least twice during the classified hearings friday that the cia memo about the attack included the term al qaeda and there was tremendous pressure to get at the talking points and not to quote relitigate every issue. reviewed by the deputies committee which includes appointees from the white house as well as under secretaries from defense state officials from the cia as well as the miller. i don't have any comment on that one way or the other. i frankly cannot speak to that at all. the cia may have some comment later today or the dni may have some comment later today with regard to the time line on the talking points. >> that said, today there was no response on the time line from the dni. the nat
motivated to investigate those e-mails. something like that should not and would not rise to an fbi probe? >> it's a great question, and what we found out was the way he was being described was really inaccurate. people had initially reported and republican leaders had described him as a whistleblower who came forward, complaining to cantor, house majority leader cantor's office because he was worried the fbi investigation that uncovered an affair by the cia director david petraeus was stalled for political reasons. it was implied he was concerned about the progress of this case and worried about it being shelved improperly. what we found in our reporting is sources very close to humphries and aware of his account, briefed on his information, tell us quite a different story about the agent. he's a tampa agent who had a long-standing sort of social acquaintance with jill kelley, the woman in tampa. he basically forwarded some information to his tampa fbi colleagues about harassing e-mails that were more interesting than everyday harassing e-mails because they mentioned a four-star general.
